In Belgium, environmental criminal law is characterized by a multitude of regulations and incriminations. Indeed the implementation of the environmental criminal law depends on multiple levels of authorities (federal, regional and local). It is difficult both for the potential infringers and for the controlling authorities to determine the relevant legislation. Moreover, the many facets of the topic, combined with the lack of uniform policy of legal proceedings, causes noticeable differences as regards control (both the judicial control and the administrative control). The risk of « shopping » by the (potential) infringers cannot thus be neglected.

A data base is an appropriate response to the diversity and the absence of transparency described above. This data base will constitute an accessible instrument in which the environmental infringements and the sanctions (limited to the field of waste) will be clearly presented. At the same time a methodology will be developed in order to be able to update the examined data.
