Description :

The current project wishes to contribute first of all to the development of significant experiments in the context of prison sentences.
Detainees will be asked to cooperate with various initiatives that are reparative- and victim-oriented, and that are set up in four Belgian prisons on an experimental basis. The conceptualisation, application, and evaluation of these experiments will occur in continuous concertation with the penitentiary institutions. the participation of detainees is based on their sense of responsibility, on their experience and awareness of guilt and on their willingness to move in the direction of victims for repairing the harm done and for compensating the ensuing damage.

Secondly, the project will specifically concentrate on the possibilities for the settlement of damages between offenders and victims. Several such initiatives have emerged during the last decade, and the research will investigate to which extent these modalities are used (effectiveness), and to which extent they lead to a full or partial settlement of the damages. The system of reference for these new legal and experimental measures lies in the application of the standing as partie civile and the measurements of its effects. assessing the result of the experimental forms of damage setllement allows for a more precise determination of their position in the totality of the criminal procedure.

Both the research results concerning the reparation- and victim-oriented execution of prison sentences, as well as the different forms of damage settlement have to be analysed and evaluated in function of their actual contribution to the realisation of a reparation- and victim-oriented judicial policy.
