Description :

This research stems from two observations: on one hand, in Belgium as elsewhere medical experiments involving human subjects are conducted; on the other hand, these subjects must enjoy specific legal protection.
The central problem is thus to elaborate, for the subjects of medical experiments, a system of legal protection that answers this specific need, without rendering medical research impossible.
It emerges from an examination of the central issues that the most appropriate method used is comparative law. Neighbouring countries already have legislation in this area. In addition to these foreign models of legal protection, we make use of a number of international
