Settling consumer disputes : extending to citizens certain existing provisions

Research project PC/14 (Research action PC)

Persons :

Description :

The concern that citizens must be guaranteed access to the judicial system is embodied notably in research aimed at adapting modalities for settling disputes to citizens' needs.
In the field of consumer protection especially, the social, economic, and psychological obstacles can be inhibitory, as can the individualistic character of the right to initiate action. To this can be added the inadequacy of both in-court and out-of-court modalities for settling disputes.
The revelation of these deficiencies has led to proposals for, or to the taking of, initiatives whose applicability extends beyond the limited framework of consumerism (simplified procedures for "minor disputes", extension of the right to initiate action to groups, development of out-of-court modalities for settling disputes, ....)
The objective of this research is to determine, on the basis of observed trends in consumer protection, what exactly has been achieved and what reforms are required in order to define an effective policy for the legal protection of citizens.
