Protecting patients' rights in the context of social, medical and technological evolution

Progress in knowledge and in medical experimentation combine with technological developments and with social trends to change the terms of relations between citizens-patients and providers of health care. A need is felt to update the legal aspects of the therapeutic relationship in several ways.
On one hand, patients' rights should be better specified and established as concerns the choices inherent in the care itself, the information pertaining to it, the responsibility of the doctor, and the protection guaranteed to the victims of therapeutic accidents.

The researchers seek to establish theoretical bases on which to develop values and new legal concepts, attention being paid to the modalities of their application. Three areas of application are retained to this end: the theory of free and informed consent in the therapeutic relationship, the protection of medical data (medical confidentiality and protection of the patient's privacy), and the donation of organs.

A socio-economic and ethical reflection accompanies the legal analysis so as to render the study fully effective towards improving patient protection.
